(Born UK hereafter is referred to as ‘us’, ‘we’ or ‘our’.  Customer hereafter is referred to as ‘you’ and ‘your’).

Only those who are 18 years and over are permitted to make purchases on this website.

The Terms and Conditions are under regular review and any updates will be placed on this page and should be read before each purchase. By using our website you agree to accept the Terms and Conditions.  We will not file a copy of this contract between you and us.

No other person shall have a right to enforce any of the Terms and Conditions and the contract cannot be assigned or sub-contracted to anyone else. You agree that you will be personally responsible for your use of our website and any activity in your account. 

Our website is for your personal non-commercial use only and items should not be re-sold.  We reserve the right to restrict multiple quantities of an item being dispatched to any one customer or delivery address.  If we determine that you have breached the Terms and Conditions we may deny you access to our website. You agree to compensate us fully, including legal fees, arising from any breach.

We aim to ensure we deliver a fast, secure, reliable service and the information placed on our website is not misleading, is accurate and is up to date.  However, we cannot guarantee that this is error free. We are not responsible for any errors resulting from this which may incur any loss or damage you may suffer through our website, or that the server which makes our website available is virus free. We cannot be held responsible for any loss you may suffer if a third party obtains unauthorised access to any data you provide when accessing or ordering from our website.  Therefore, we strongly recommend that you ensure you have up to date virus checking software installed and you take steps to protect your privacy and identity. 

We reserve the right to change or remove any information uploaded onto our website or third party sites.  

Our liability in connection with any item purchased through our site is strictly limited to the purchase price of that item including delivery costs and the reasonable cost of returning the item to us.  We do not exclude or limit in any way for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any matter for which it would be illegal for us to exclude our liability. 

Orders

Once you have submitted an order, you will receive an acknowledgment email detailing the items you have ordered.  This is not confirmation that the order is accepted.  The contract between you and us is formed when we dispatch the items you have ordered and a dispatch email has been sent. Until the items are dispatched, the order may not be accepted. We reserve the right not to accept your order in the event of for example, that we are unable to obtain authorisation for payment or that shipping restrictions apply.  We may also refuse to accept a transaction for any reason at our sole discretion and we will not be liable to you or any third party by reason of our withdrawal. 

If you are purchasing items from our Born Lucky collection, the current lead time from order to dispatch is approximately 16 days. 

All items in your shopping basket are not reserved and may be purchased by other customers. 

Although we make every effort to ensure the colours of our items are displayed accurately, a slight colour variation may occur on individual monitor displays.

Prices and payment

The price of items are in GBP and exclude delivery costs.  Methods of payment accepted are debit/ credit card or PayPal.  Payment is in advance but will not be charged until the dispatch of your order.  Whilst every effort is made to ensure details on our website are accurate, we may from time to time discover an error in the pricing of items. We shall be under no obligation to accept or fulfil an order for an incorrectly priced item and reserve the right to cancel such an order.

If you are a customer whose credit/debit card is not denominated in sterling, the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction.  We recommend to customers purchasing from outside the UK to contact their local customs authority to determine a landed cost price prior to placing an order.

How to cancel an order

An order can only be cancelled before it has been dispatched. However, if you are purchasing items from our Born Lucky collection, we ask that you cancel your order within 24 hours of your order being acknowledged.  Please contact us as soon as possible if you wish to cancel an order. If your order has not been dispatched we will be able to issue a refund including delivery costs for all items cancelled.  If it is too late to cancel your order then you will need to return your items to us.  Returns must be received by us within 14 days of the dispatch date.  Delivery costs will not be refunded.  Refunds are processed on receipt of the items by us and can take up 14 days to appear in your account.

Delivery

All deliveries require a signature:

• Standard Delivery £3.99. 3-5 working days.
• Next Day (UK only) £7.50. Orders placed before 12 noon are guaranteed next working day delivery.  Next day does not include weekend delivery. 
• Europe £10.00 up to 7 working days.
• Worldwide £15.00 up to 10 working days.

If you are purchasing items from our Born Lucky collection, the current lead time from order to dispatch is approximately 16 days. 

If delivery is delayed by events beyond our control, we will contact you as soon as possible and we will make every effort to minimise the effect it has on you. You may cancel your order for a refund including delivery costs for any items you have not received.

Delivery will be completed when our courier attempts to deliver the items to you or a person identified by your delivery address or location. The items will be your responsibility from the completion of delivery. Our courier may refuse to deliver your order if they are of the opinion that the delivery address or location is considered to be unsafe. 

Returns

If you wish to return any items, they must be received by us within 14 days of the dispatch date.  We are not responsible for postage costs incurred when returning any items to us, nor are we responsible for any loss or damage to the items during transit.   We therefore, strongly recommend that you use a secure tracked delivery method.  All items must be returned in the original packaging (including gift box if applicable) and in a re-saleable condition meaning the product and its packaging, labels and tags are undamaged, unworn, unmarked and unwashed. We reserve the right to reduce the amount due to be refunded (up to the value of the item) where the value of the item is diminished through your handling.  

Refunds

Refunds are processed if we are satisfied that our returns policy has been met.  Refunds will be processed on receipt of the items by us and can take up 14 days to appear in your account.  You will be refunded using the same method of payment used when placing your order.

Faults and incorrect items received

We aim to ensure our items are of the highest quality and every care is taken during dispatch to ensure all orders are processed correctly.  If you receive a faulty or incorrect item, please accept our apologies for the inconvenience this may cause.  Faulty or incorrect items can be returned to us within 14 days of the dispatch date for a refund including delivery costs.

Exchanges

Unfortunately we do not offer exchanges.  Please return your item to us for a refund and place a new order. Delivery costs will not be refunded.

Care

Each item goes through testing during the design process and our care instructions are specifically tailored to each item.  Please follow these carefully.  Damage to items through incorrect care is not a fault or a reason for return.

Events beyond our control

If an event beyond our control takes place and affects the performance of our obligations under the contract between you and us, we will contact you as soon as we are able to as our obligations could be suspended during that time. 

Intellectual Property including copyright

You have no rights in relation to any intellectual property on our website, for example logos and trademarks.  You agree not to copy, reproduce, edit, publish, display or create derivative work. Any reproduction or redistribution is prohibited and may result in civil and criminal action.

Third Party Sites

We are not responsible for any third party sites whether accessed through our links or not.

Wavier

No waiver by us shall be deemed as a waiver of any other breach.

Severability

If any of the Terms and Conditions shall be deemed unlawful, void or for any reason unenforceable it shall not affect the validity and enforceability of the remaining Terms and Conditions.

Law

These Terms and Conditions are governed by the laws of England and Wales.
